Fatal car accidents may stem from negligent driving

Two individuals tragically lost their lives in a motor vehicle crash in Virginia recently. The crash took place early in the morning on a Sunday. Sometimes, these types of car accidents happen because a motorist was negligent while behind the wheel, which is grounds for litigation.

The recent car accident involved a single automobile. It took place at about 2:45 a.m. along Interstate 95. According to police, a car with out-of-state plates ended up veering off the interstate.

At that point, the car reportedly struck a tree, flipped over and then caught fire. Two individuals inside the car passed away at the accident scene. Authorities at the time were trying to identify the two victims and said they believed that the registered car owner might have been inside the car. Police continued to investigate the collision.

If the police investigation reveals that the deceased driver caused the Virginia accident due to careless driving -- such as speeding or texting while driving -- the surviving loved ones of the deceased passenger may choose to file a wrongful death claim against the driver's estate. The claim may also be filed against anybody else with an ownership interest in the motor vehicle. In their claim, the grieving loved ones of the passenger may seek the reimbursement of monetary damages sustained in the collision. Competent proof of negligence is necessary to establish liability before the court hearing the case. A successfully fought suit may lead to a financial award that might help with addressing funeral costs and other losses associated with these types of car accidents.
