The homeowner’s association takes care of certain maintenance issues, including public area landscaping in many master-planned communities in Virginia. It also helps ensures the area is safe for residents. At Patel & Dalrymple, PLLC we often handle disputes between homeowners and HOAs.
Bankrate, LLC reports that homeowners do not always know the association rules. Most find out when they receive notification of a fine or lien. Here are some of the most common issues that cause problems between residents and an HOA.
Rentals – Many homeowners with extra rooms are using them as short-term rentals for vacationers. They may also sublet the entire home for short periods. Many HOA’s do not allow subletting for security and insurance reasons.
Vehicles – The community’s bylaws often limit the type and number of automobiles on the property. Depending on your HOA, you may have to store commercial vehicles, RVs and boats elsewhere. There are also generally speed limits and parking rules within the community.
Trash Receptacles – Trash cans can attract pests and give the neighborhood an unkempt appearance. Check the requirements about how early you can take them to the curb, and if you must store them out of sight by a specific time.
Landscaping – Overgrown grass and weeds make your home look neglected. The homeowner’s association may send you a letter and levy fines when left unattended. Bylaws may also specify whether specific plants, shrubs or trees cannot be in the front yard.
